• Intent to Store No Information: It is the core operational intent of Neuropath to never store, log, retain, or maintain any information, records, messages, or metadata whatsoever.
• Scope and Applicability: While our infrastructure is designed around this zero-retention intent, if any information, data, communications, or records are ever stored, collected, retained, or intercepted under any circumstance, this Privacy Policy and our Terms of Service shall fully apply to such data and govern its handling, retention, and transmission.
• Data Discretion and Third-Party Transmissions: You acknowledge and agree that Neuropath reserves the absolute, unfettered right to collect, retain, store, log, inspect, analyze, or transmit any data, metadata, communications, connection timestamps, or user information at any time, under any circumstances, and at our sole and absolute discretion, without notice to you. You explicitly authorize Neuropath to transfer, disclose, share, or transmit any information or records we may possess or intercept to any third party, private entity, foreign or domestic government agency, law enforcement body, or regulatory authority at our sole discretion, without restriction or liability.

• Complete Release of Claims: By using the App, you forever and irrevocably release, discharge, and hold harmless Neuropath Technologies Inc., its officers, directors, employees, contractors, agents, successors, and assigns from any and all claims, demands, damages, losses, liabilities, and causes of action of every kind and nature, whether known or unknown, suspected or unsuspected, arising out of or in any way connected with your use of the App, data handling practices, or data security measures.
• Absolute Waiver of Right to Sue for Data Breaches: You explicitly agree that you can never sue, file a claim, initiate arbitration, or hold Neuropath liable under any legal theory (including negligence, gross negligence, breach of contract, statutory liability, or tort) in the event of any security incident, system failure, unauthorized access, interception, data leak, or data breach resulting in the exposure, theft, loss, or compromise of any information or communications associated with your account or device. You waive all rights to pursue any legal action against Neuropath in connection with a data breach.
• Information Retention & Transmission Waiver: You further agree that you shall have no right to sue or seek legal recourse against Neuropath even if Neuropath decides to retain, store, monitor, or transmit your information, communications, or metadata to another agency, corporate entity, or government body.
• Attorney's Fees and Judgment Indemnification Upon Suit: By using this mobile application, you explicitly agree that if you initiate any lawsuit, claim, or legal proceeding against Neuropath Technologies Inc. in violation of these waivers, you shall be entirely responsible for and agree to pay all attorney's fees, legal costs, expert witness fees, and court costs associated with the defense of the suit, incurred by Neuropath. Furthermore, even if Neuropath is found liable or a court enters a judgment against Neuropath in such a lawsuit, you expressly agree that you remain fully responsible for and agree to pay the entirety of any such judgment, holding Neuropath completely harmless from any financial payout or obligation.
• Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to this Privacy Policy or the App shall be resolved on an individual basis. You expressly waive any right to bring, join, or participate in any class action, collective action, or representative proceeding against Neuropath Technologies Inc.

To the maximum extent permitted by applicable New York law, in no event shall Neuropath Technologies Inc. be liable for any direct, indirect, incidental, special, consequential, or punitive damages whatsoever arising out of or resulting from data handling, data retention, data transmission, or data breaches, even if Neuropath has been advised of the possibility of such damages.

• Six-Digit Identification Number: Every user is assigned a unique six-digit identification number solely for connecting with other Neuropath members. You are strictly responsible for maintaining the confidentiality of your assigned number and device.
• Device Compromise: Because no system can guarantee absolute physical security of endpoint devices, you bear sole responsibility for your hardware, software, and local security. Neuropath accepts zero liability for compromised local environments.

This Privacy Policy, and any dispute arising out of or related to it or the App, shall be governed by, construed, and enforced in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. You agree that any permitted legal action or proceeding arising herefrom shall be brought exclusively in the state or federal courts located in New York, and you hereby consent to the personal jurisdiction and exclusive venue of such courts, subject to the absolute liability, fee-shifting, and lawsuit waivers outlined in Section 2.

We may modify, amend, or update this Privacy Policy at any time and at our sole discretion. Any changes will be effective immediately upon posting the updated policy within the App or on our website (oneneurapath.com). Your continued use of the App following any changes constitutes your binding acceptance of the updated terms and waivers.
